FAA Part 108: Opening the Door for Scalable Drone Operations

The FAA Part 108 proposed rule is a major step toward normalizing Beyond Visual Line of Sight (BVLOS) drone operations in the United States. If adopted, it would enable a range of high-value missions such as package delivery, agriculture, aerial surveying, public safety, recreation, and flight testing, while putting clear safety, security, and operational requirements in place.

Under the rule, BVLOS flights would occur at or below 400 feet from pre-designated, access-controlled locations, with all operators required to secure FAA approval for their flight areas. Operators would need to ensure reliable communications, review Notices to Airmen (NOTAMs), and have mitigation plans for hazards and lost-link scenarios.

A key feature is the introduction of Automated Data Service Providers (ADSPs) to keep drones safely separated from each other and manned aircraft. The rule also allows certain aircraft up to 1,320 lbs. to operate without traditional airworthiness certificates, instead relying on industry consensus standards, streamlining the approval process for new platforms.

Security is another focus. Operators and manufacturers would need to implement physical and cybersecurity measures, protect against interference, and meet TSA personnel screening requirements. The FAA also outlines two authorization paths:

  • Permits for lower-risk operations such as small-scale surveying or delivery.
  • Certificates for higher-risk operations, requiring more oversight, safety management systems, and training.

If finalized, the FAA Part 108 rule would give the drone industry a clear regulatory framework to scale BVLOS operations safely and efficiently, unlocking new possibilities for commercial, industrial, and emergency response applications.
